From FUNDEF to FUNDEB: the political process of Constitutional Amendment n. 53/2006 formulation

Abstract

The aim of this paper is to show how theprocess of drawing up the CA n.º 53/2005 wascarried out, describing the legislative process byusing documents that instructed the proposedconstitutional rules for financing education inthe period between the promulgation of the CAn.º 14/1996 and the CA n.º 53/2005. This reviewexamines the documents published by theHouse of Representatives’ Daily Journal between1996 and 2006, focusing on the contents ofthe Constitutional Amendment Proposals thatculminated in the FUNDEB and in its procedures,as well as emphasizing the role of rapporteurs,special committees and the House Membersplenary in this legislative procedure. The resultsof the search showed that the amendments n.º14/1996 and n.º 53/2006 formalize an importantfundament of the educational reforms implementedin basic education by the governments FernandoHenrique Cardoso and Luis Inacio Lula da Silva,establishing the policy of funds not only asresource distribution and control of educationalexpenses, but as a resource for the regulation ofthe federal action through subnational entities oneducation policies.
