THE CONVENTIONALITY CONTROL AND THE SELF-ASSESSMENT OF BRAZILIAN JUDICIARY

The phenomenon known as conventionality control of laws changed the way of understanding the Law in the contemporary world, putting together subjects of international law and domestic law methodologies. However, many questionings regarding this regulatory control still persist. The purpose of this paper is to discuss how the conventionality control has transformed the Judicial Branch’s understanding about the implementation of human rights in Brazil. Using an analytical-critical methodology, it is observed that the conventionality control, more than a normative control exercise, is an opportunity for the Judiciary to review its concepts about itself.
