O presente estuda apresenta a experiência do ativismo judicial em três sistemas jurídicos diferentes: Estados Unidos, Alemanha e Brasil. Para tanto, a investigação valer-se-á das principais decisões dos tribunais superiores desses países no controle de constitucionalidade, qualificando-as como indicativos do ativismo. Assim, parte-se do pressuposto de que o estudo comparativo do fenômeno, nesses três contextos diferentes, fornecerá elementos para compreender o ativismo judicial praticado em terrae brasilis.Downloads
