Family Constellations in the Judiciary: a systematic scoping review of the literature

This article presents a systematic scoping review examining the use of Family Constellation practices within the Judiciary, aiming to understand their application and the theoretical and legal justifications for their use—particularly in family courts and domestic violence cases. The study was conducted in four stages. The first stage involved a database search for articles published between 2016 and 2021, using specific descriptors and search strings. The second stage consisted of screening and selecting titles and abstracts. In the third stage, the researchers read and critically assessed the full texts of the selected articles based on defined inclusion and exclusion criteria. At the end of this stage, 40 articles were selected for in-depth qualitative analysis. In the fourth stage, basic information from these articles was compiled and coded according to the review objectives. Most of the selected articles were dogmatic and/or theoretical in nature, written by legal professionals, and lacked scientific evidence supporting the adoption of Family Constellations in judicial settings. The findings revealed: a) theoretical and operational confusion surrounding Family Constellation practices; b) assertions of universality, unquestionability, and efficacy both within and outside the Judiciary; and c) a diminished view of families (and their dynamics) and of intimate relationships marked by domestic violence. Based on these findings, the article proposes the adoption of principles of responsible innovation in the implementation of judicial policies.
